Vacation Rental Lease Agreement

1.Rental Property:

The Landlord agrees to rent to the Tenant the property described as Beach Tower B-402, Ko’Olina Beach Villas, 92-102 Waialii Place, Kapolei Hawaii 96707 which will be referred to as “Leased Premises.”

2.Use and Occupancy of Vacation Rental Property and Resort Areas:

Only the people registered are permitted to occupy the residence overnight during the rental period, and never more than the max of 6 without specific written permission from the landlord. Tenants will use the property only as a vacation rental. Any change or addition in occupants or length of occupancy must be cleared by the Landlord and will be subject to immediate eviction for misrepresentation. The landlord has complete discretion if more than permitted or registered guests are staying in the unit, including loss of all rents and security deposit if eviction results. In addition to occupancy limits set by the bylaws of the Beach Villas Resort, the same limit applies to the number of people who may use the pools, gym and other areas during your stay. You can reserve the “Owner’s lounge” for large parties through the front desk.

3.Terms of Payment:

50% of the rental, tax and cleaning is due at time of reservation.Balance of the rent and all fees plus security deposit are due 30 days prior to occupancy (60 days for holiday rentals). In the event of cancellation prior to 60 days before rental, renter will be charged for all credit card processing fees. Cancellations occurring within 60 days will result in the loss of all fees paid. After final payment is made no refund will be provided. Waiver of this is at the sole discretion of the landlord and would only occur if the property is able to be re-rented at the same rate and dates. In the event of unforeseen circumstances (sale of property, removal of property from rental market, natural disaster, etc) the owner or manager of the property may cancel up to 60 days prior to reservation, with full return of all funds to renting party.

4.Maintenance, Condition, and NO SMOKING Policy:

Landlord is responsible for maintaining the unit in good condition during Tenants occupancy. Tenant agrees to keep the premises clean and in good condition during occupancy, and remove all rubbish, garbage and dispose of trash and other waste in proper hallway trash receptacles. Nothing can be hung from the balcony railings and all rules of the Condo Association must be abided by, during the Tenants occupancy. Tenant agrees to pay for any and all fines resulting from the issuance of rules violations to any in their party or placed on their doors or vehicles during their occupancy. A copy of Association rules will be supplied to the Tenant upon arrival. Beach Villas Resort is a non-smoking building, including the balconies. The only approved smoking place is located behind Ocean Tower. Any violation of this rule will result in the Tenant being evicted and loss of security deposit and remaining rental amount.

It is the responsibility of the Tenant to promptly notify the Landlord or Agent of the need for any repairs of which the Tenant becomes aware.

The Tenant agrees to return the leased premises to the Landlord at the end of the Lease Agreement in the same condition it was at the beginning of the Lease Agreement.

5.Pets:

No pets of any kind are allowed in the building.

6.Parking:

Covered parking for one car is located on level BP-2 in the underground garage. The space allocated number is BP-094. Additional parking is available from the front desk at no charge.

7.Right of Entry:

Landlord reserves the right to enter the property during the Tenants occupancy to inspect the premises, make repairs, or investigate complaints. Every effort will be made to contact the Tenant if possible; however this right of access may be without notice if the situation is determined to be an emergency or necessary at the sole discretion of the Landlord or Agent.

8.Assignment or Sublease:

Tenant agrees not to transfer, assign, or sub-lease the Leased Premises.

9.The Beach Villas are privately owned rental units. Tenants understand and agree that starter supplies are included in the price of rent. All additional supplies needed by the renting party must be procured by the renter.
